TERMS AND CONDITIONS OF AGTL

• AGTL has examined the gemstone carefully with specialized instruments and prepared this report to the best of its knowledge and professional standards at the time report is issued.
• The client has requested to issue a Gemological Report by AGTL for the goods deposited for identification on the acceptance of the terms and conditions of AGTL.
• Neither AGTL nor any member of its staff shall, at any time, be held responsible for any discrepancy which may result from the application of the grading methods.
• Neither the client nor any purchaser of the gemstone shall regard this report neither as an appraisal nor as guarantee and/or warranty.
• This report in or in part shall not be used for any legal action and thereby no claims can be made in any regard.
• In the event of any claim by client or any person for damage to the gemstone, damage resulting directly or indirectly from this report, the liability of AGTL shall be limited to the amount is received as testing fee in connection with this report. All necessary precautions and care shall be taken by AGTL.
• Testing report issued by AGTL are concluded on the basis of thorough analysis of Gemstone submitted for testing, as per the scientific tests performed with Gemological equipment. Tests which are not applicable / useful in the identification are not performed.
• AGTL Gemological Report does not indicate about any “ORIGINS” and “TREATMENTS” in gemstones, unless otherwise specified. But if specified, then Origin and Treatment reports only be issued on the request of client when it is completely identified on the basis of data depositary/store at AGTL.
• Writing ORIGINS and TREATMENTS, Is the opinion of the laboratory & it is decided by research, analysis & data depositary at AGTL. And there should be possibilities of varying opinion regarding Origins and Treatments in compared with different Gemological research bodies, In such cases ATHARV GEM TESTING LAB (AGTL), or any member of its staff, may not be held responsible for any discrepancy.
• Identification and treatment disclosers are done on the basis of present expertise and knowledge at the time of analysis. Result given for the same stone may vary later depending on the experience transformation.
• AGTL report does not indicate about any treatment done on the specimen unless otherwise specified.
• A gemstone can be treated, modified or re-cut to enhance its color and clarity at any time after the issue of this report. Therefore the results of report reflect the findings at the time it is issued.
• Any corrections or alternations of any form shall not be accepted on the AGTL gemstone reports.
• AGTL report is considered null or void if any alterations is / are made to the gemstone or to the report itself.
• AGTL report does not indicate whether the stone is natural or synthetic or has been treated or not by any process whatsoever, unless otherwise specified on the report.
• AGTL report does not indicate about NATURAL or CULTURED origin of PEARL, unless otherwise specified.
• Mounted gemstones are tested & graded only up to the extent that mounting permits examination.
• HARDNESS is referred data in AGTL testing report.
• In “Gemstone Identification Report” (Testing Category) Treatment/Enhancement Test and Analysis is not done.
• Gemstone Treatment/Enhancement analysis not done unless or until specified.
• The information contained in this report is solely the opinion of AGTL regarding the characteristics of the item submitted for examination and represents the opinion of AGTL regarding said item at the time of examination only.
• The conclusion on the authenticity and treatment of gemstones is an opinion of the laboratory.
• Opinion may vary reasonably, from other laboratories depending on the tests performed. Hence, AGTL or any of its members cannot be held responsible for the same.
• AGTL does not give any opinion of any type about quality, value and origin of the tested stone.
• AGTL will not be held responsible for any consequences resulting from incomplete or erroneous data in the report such as errors in measurements and weight, typing errors, and errors in the determination and opinion of the authenticity and errors in the declaration of treatments & origin.
• AGTL is on no account responsible for possible dissimilarities and/or differences that could appear as to the characteristics covered in the report from repeated examinations or as a result of other methods applied or the possible inaccuracy due to technical/mechanical defects/errors of the instruments/equipment used.
• Therefore, neither AGTL nor any of its employees shall, at any time, be held responsible for any discrepancy which may result from the application of other testing methods.
• Photograph printed on the report is mere an approximate image of the stone, which may vary in color or size of the original stone, such variations are result of paper size used for report, camera and printer limitations.
• Testing reports issued by AGTL are not certificate for valuation, guarantee, appraisal or legal document and does not pertain to the quality of the stone, neither the client or any purchaser shall regard the report as the same.
• AGTL is permitted to revise or amend mentioned Terms and conditions at any time as it sees fit without any notification, and hence customer are expected to review these Terms and conditions on a regular basis.
• AGTL report contains only the characteristics of the gemstone described here in after it has been graded, tested, examined and analyzed by ATHARV GEM TESTING LAB (AGTL) carefully with specialized gemological instruments under 10X magnification, including fully corrected triplet loupe and binocular Microscope, Immersion scope, Polariscope, Electronic carat balance and ancillary instrument as necessary.
• All matters, disputes or reference to arbitration arising out of this report shall be subject to jurisdiction of Bhopal in state of Madhya Pradesh, India.
